Introduction

The Platform is owned by BlackBoard (hereinafter referred to as “BlackBoard”). By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms.

Unless otherwise defined within specific sections of this document, any term capitalized herein and not explicitly defined shall have the meanings assigned to them below. These terms may be used interchangeably in masculine, feminine, or neutral forms, and in singular or plural as appropriate to the context.

Use of Your Personal Information

Your personal information will be used strictly in accordance with our privacy policies. We will process your personal data to fulfill our contractual obligations, such as granting access to Online Courses on the Platform. Additionally, we may collect and use your information for marketing purposes, only with your explicit consent.

Site Description

The Platform serves as a dynamic learning community designed for individuals seeking to acquire new skills from industry professionals. Through BlackBoard, Users can enroll in online courses, engage in discussion forums, connect with like-minded learners, and access curated educational content. Users also have the option to publish projects, images, audio, and video files, and share promotions or discounts, where authorized. Users gain access to audiovisual materials, forums, and direct communication with instructors upon registering for Courses.

Acceptance of the Conditions

By accessing the Platform provided by BlackBoard, you acknowledge that you have read, understood, and agree to these terms and conditions (the "Conditions"). Your use of the Platform constitutes your acceptance of these Conditions, which, together with our Privacy Policies, govern your relationship with us. You may only use the Platform if you accept these Conditions. If you do not agree to them, you are advised not to access or use the Platform’s Services.

Availability of Content

The content presented on the Platform may include texts, images, audio, and video, either created by BlackBoard or provided by third parties. This content may also contain links to external websites or applications not affiliated with BlackBoard. BlackBoard does not guarantee the availability of content on the Platform at all times. We reserve the right to modify, suspend, or introduce any features or functionalities at any time.

Access and Use of the Platform

Users may access the Platform’s functionalities and services upon registering for an Account and selecting a Membership. Users are prohibited from copying or downloading any educational videos as these materials remain the intellectual property of BlackBoard or its designated third parties. Access to the Platform is restricted to individuals with legal capacity under applicable laws. In cases where a minor wishes to access the Platform, the responsibility lies with the individual(s) exercising parental authority or guardianship.

Registration

To create an Account, Users must complete the registration process by providing required personal information. Each User may register only one Account and must ensure that the information provided is accurate and up to date. Failure to comply with this requirement may result in suspension or cancellation of the Account.

Liability for Passwords

The User is responsible for maintaining the confidentiality of their Account credentials and for all activities conducted within their Account. In case of unauthorized access or password loss, Users must immediately notify BlackBoard. BlackBoard shall not be liable for any damages resulting from the disclosure of login credentials.

Correct Use of the Platform

The Platform must be used for lawful purposes. The User agrees to adhere to the legal system, maintain public order, and respect ethical standards. Users are prohibited from publishing inappropriate or infringing content, sending spam, or using the Platform for any commercial activities without prior authorization.

Content Shared on the Platform

Users retain rights to their shared content, but by uploading content to the Platform, they grant BlackBoard a worldwide, non-exclusive license to use, distribute, and modify the content. Users also permit the sharing of their content across integrated social media platforms. BlackBoard is not responsible for unauthorized copying or use of User content.

Products and Memberships

BlackBoard offers various Products and Memberships, including one-time purchases and subscription-based services. Memberships and Products may be updated, modified, or discontinued at the discretion of BlackBoard.

Cancellations and Refund Policy

You may cancel your course purchase within 14 days of purchase, provided you have not accessed the course content. Refunds are not available once course materials have been accessed or delivered. This policy does not affect your statutory rights.

Payment Methods

BlackBoard accepts payments via credit/debit cards and other payment platforms. Users authorize BlackBoard to charge the payment method associated with their Account for Membership renewals unless cancelled in advance.

Relationship with Instructors

BlackBoard does not establish an employment relationship with instructors, who operate as independent professionals. Any issues related to course content should be directed to info@blackboard.org.uk.

Intellectual Property

All content and software on the Platform are the exclusive property of BlackBoard or its suppliers. Unauthorized use of any material on the Platform is strictly prohibited.

Privacy

BlackBoard complies with the UK’s data protection laws and takes measures to protect User data. Please review our Privacy Policy for more details.

Indemnification

The User agrees to indemnify and hold harmless BlackBoard from any claims arising from their use of the Platform, violation of these Terms, or infringement of any third-party rights.

Jurisdiction and Applicable Law
